Federal Court Orders Freedom of Abrego Garcia from Immigration Custody
A court has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, finding his ongoing confinement is without lawful basis.
"Since his return from erroneous detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her ruling.
The case stems from a mistaken removal to El Salvador earlier this year, which the government later admitted was an mistake. Following his repatriation to the United States to answer human smuggling allegations, he was detained in immigration custody.
In her decision, the court pointed out that the government does not have a valid removal order, which prevents them from removing Mr. Abrego Garcia "at this juncture."

The legal challenge involve conflicting claims. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently disputes this claim.

The judge, who was overseeing his challenge to deportation in a Maryland district court, determined that he must now comply with the conditions of his bond from jail in Tennessee. This order effectively transfers his supervision to the Tennessee court.
